Terms of service

1. Agreement

These terms are between 1924 Digital, Istanbul, Turkey ("Fluxy", "we") and the business that creates a Fluxy workspace ("you"). By creating or using a workspace you accept these terms on behalf of your business. If you have a signed agreement with us, that agreement prevails where the two differ.

2. The service

Fluxy provides AI agents that answer your customers on channels you connect (WhatsApp Business Platform, Instagram messaging, web chat), a console to configure and supervise them, and integrations with your own tools. We may change or improve features over time. We will give reasonable notice before removing a feature you rely on.

3. Your account

  • You are responsible for the people you invite to your workspace and for what they do in it.
  • Keep credentials confidential. Tell us at info@getfluxy.io if you suspect unauthorised access.
  • You must be at least 18 and authorised to bind your business.

4. Your channels and content

  • You must own or be authorised to use every phone number, Instagram account and website you connect.
  • You are the controller of your customers' data. You are responsible for having a lawful basis to message them and for the instructions and business facts you give the agent.
  • You keep all rights to your content. You grant us the licence needed to run the service for you.

5. Meta platforms

Use of WhatsApp and Instagram through Fluxy is also governed by Meta's terms, including the WhatsApp Business Terms, WhatsApp Business Messaging Policy and Meta Platform Terms. You must comply with them, including opt-in requirements and message category rules. Meta charges for some WhatsApp messages on its platform independently of Fluxy (see section 8).

6. Acceptable use

You must not use Fluxy to send unsolicited messages, to deceive people about whether they are talking to an AI where the law requires disclosure, to collect data you have no right to collect, to infringe others' rights, or to send unlawful, harmful or abusive content. We may suspend a workspace that we reasonably believe breaks this section or Meta's policies, and we will tell you why.

7. AI output

Agent replies are generated by AI models and may be wrong. Fluxy gives you tools to limit what the agent may decide alone and to review conversations. You remain responsible for the agent's replies to your customers as you would be for a member of your staff.

8. Fees

Fees are as stated on our pricing page for your plan, or in your signed agreement. Plans include a monthly number of customer conversations; conversations above that number are charged at your plan's per-conversation rate. Prices exclude VAT and other applicable taxes. Plans renew monthly and can be changed or cancelled at any time; a cancellation takes effect at the end of the current billing period. We will give at least 30 days' notice of a price change. Unpaid fees may lead to suspension after notice.

Messaging fees that Meta charges for WhatsApp are billed by Meta to your own WhatsApp Business account and are not part of Fluxy's fees.

9. Data protection

We process personal data as described in our privacy policy. Where required, a data processing agreement is available on request at info@getfluxy.io.

10. Availability and liability

We aim for high availability but do not guarantee uninterrupted service; third-party platforms such as Meta and AI model providers are outside our control. To the extent permitted by law, our total liability under these terms in any twelve-month period is limited to the fees you paid us in that period, and we are not liable for indirect losses such as lost profits. Nothing here limits liability that cannot be limited by law.

11. Term and termination

You can stop using Fluxy and delete your workspace at any time. We can end these terms with 30 days' notice, or immediately for a serious breach. After termination we delete your data as described in the privacy policy.

12. Changes

We may update these terms. We will post the new version here and, for material changes, notify workspace admins in the console at least 14 days before they take effect.

13. Governing law

These terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the courts of Istanbul, without prejudice to mandatory consumer or data protection rules where you are located.
